1. Platform Role
SideQuests is a platform that connects Quest Posters ("Posters") with Questers. SideQuests only provides the technology infrastructure for posting, finding, and completing quests. SideQuests is not a party to any agreement between Posters and Questers.
2. Platform Role and Limitation of Liability
SideQuests facilitates connections between posters and questers but does not supervise, direct, or control the work performed. Posters and questers are responsible for their own actions. SideQuests provides secure payments, identity verification, and dispute protection.
By using SideQuests, you acknowledge and agree that:
- You assume all risk associated with any quest, job, or interaction.
- SideQuests is not liable for any damages, injuries, losses, or disputes arising from user interactions.
- SideQuests does not guarantee the quality, background, or conduct of any Poster or Quester.
- SideQuests does not provide insurance, bonding, or worker's compensation.
3. User Responsibility
Users are solely responsible for their own conduct and any content they post. Users must comply with all applicable laws, not engage in fraudulent or harmful behavior, and not post illegal or prohibited quests.
4. Independent Contractor Relationship
Questers are independent contractors, not employees, agents, or joint ventures of SideQuests. SideQuests does not supervise, direct, or control Questers' work. No employment, partnership, or joint venture relationship exists.
5. No Liability
To the maximum extent permitted by law, SideQuests, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
6. Service Fee
SideQuests estimates a 14% service fee on posted quests, added on top of the quest price, never taken out of what the quester earns. The fee is disclosed at time of posting and covers site maintenance, secure Stripe payments, identity verification, 24/7 support, and dispute protection. The quester receives 100% of the quest price. Tips are 100% passed through to Questers with no service fee.
7. Stripe Connect Disclosure
Payments are processed through Stripe, Inc. SideQuests uses Stripe Connect to facilitate payouts to Questers. By using SideQuests, you agree to Stripe's Connected Account Agreement. SideQuests does not store or process credit card information - this is handled entirely by Stripe. Questers must complete Stripe's identity verification and provide banking information to receive payouts.
8. Privacy
SideQuests collects and processes personal data as described in our Privacy Policy. By using SideQuests, you consent to such processing. See our Privacy Policy.
9. Dispute Resolution
Any disputes arising from use of SideQuests shall be resolved through binding arbitration. Users agree to waive any right to a jury trial or class action. All disputes shall be governed by the laws of the State of Rhode Island.
